Virginia school may use birth record loophole to bypass transgender sports law

Arlington Public Schools (APS) is prepared to continue letting transgender male students enter female spaces–even if a court rules against them.
APS is already openly defying federal policy by permitting biological boys to enter private girls’ spaces and compete against them in sports, putting them in danger. Now, a district official is indicating that transgender students could still get past federal policies even if the court sides with the federal Department of Education on Title IX.
Accuracy In Media’s undercover investigator visited APS Supervisor of Health, Physical Education, Driver’s Education and Athletics, Chris Wilmore, to find out how far they’re willing to go to enforce biological male invasion of female spaces in the name of transgender inclusivity.
Speaking with AIM’s investigator on hidden camera, Wilmore nodded and indicated that a prospective biological male transgender student would be able to continue in girls’ sports following a potential court ruling against APS, so long as they have an altered birth certificate identifying them as female.
“Yeah,” he told AIM’s investigator when asked about the prospective student’s future if such a court ruling comes down.
“Right now, Arlington is following what our interpretation of Title IX [is] and that is students participate in the activities of the gender to which they identify, they also have access to the facilities for the gender to which they identify,” he explained.
Wilmore noted that Arlington is one of “five school divisions in northern Virginia who are refusing to follow the federal department of education’s interpretation.”
When AIM President Adam Guillette visited Wilmore with the hidden camera footage in tow, he denied coaching a prospective parent on keeping their transgender child in girls’ sports.
Guillette asked if this was the official district policy, to which Wilmore replied, “I’m not gonna speak for the district.”
The AIM president then confronted Wilmore with the case of registered sex offender Richard Cox, who was accused of reportedly exposing himself to women and children in an APS girls’ locker rooms, which are open to the public outside of school hours.
The district official admitted his knowledge of the case, but didn’t confirm any policy changes in response to the event.
Wilmore claimed he “can’t speak to what” policies are being discussed, adding that he is “new in this position.” He urged AIM to contact the district’s community relations office to find out what is being done to prevent sex offenders from committing crimes in their locker rooms.
Guillette then questioned whether he was worried about girls’ safety given the recent alleged crime by Cox. According to Wilmore, he worries “about all of our students,” rather than girls specifically.
Wilmore further refused to respond to questions about girls’ safety playing sports against biological boys, who have physical advantages. “I’m not gonna speak to that, and I have another appointment so thank you,” he said before walking off and ignoring additional questions.
The Trump administration has made clear that Title IX protects sex and not gender identity. Schools across the country were instructed to reverse course if they were prioritizing gender identity and transgender students, or risk their federal funding.
In July, the Department of Education’s Office for Civil Rights (OCR) revealed that an investigation found all five northern Virginia school divisions, including Arlington, in violation of Title IX.
“Although this type of behavior was tolerated by the previous Administration, it’s time for Northern Virginia’s experiment with radical gender ideology and unlawful discrimination to come to an end. OCR’s investigation definitively shows that these five Virginia school districts have been trampling on the rights of students in the service of an extreme political ideology,” then-Acting Assistant Secretary for Civil Rights Craig Trainor said at the time. “The Trump Administration will not sacrifice the safety, dignity, and innocence of America’s young women and girls at the altar of an anti-scientific illiberalism.”
In response, the school districts reportedly sued the federal government, and it has yet to be decided in court.
Public education officials in northern Virginia are already plotting ways to get past a negative court ruling. They want to ensure that transgender students are allowed unfettered access to girls’ spaces and sports, by any means necessary.
